Compensation secured for man injured as a result of reckless driving
Our client, a London businessman was riding his scooter to work in the bus lane, as he is legally permitted to do. As he was travelling, a transit van changed lanes, undertaking the car in front which was turning right. Our client swerved to avoid a more serious accident occurring and fell from his scooter. As a result of his fall he suffered a fractured wrist and thumb.
The van driver was prosecuted for driving without due care and attention, receiving a fine and penalty points. Despite this, his insurance company denied liability for the accident advising that no collision took place and the rider over reacted.
Claire Bracewell, of Irwin Mitchell’s specialist road traffic accident team persevered with this case and finally after issuing proceedings the insurer's solicitors admitted liability and paid compensation in excess of £15,000.
